Constitutional Mess Can they cleanse it???
Supreme Court of Pakistan is sitting there to cleanse the constitutional mess created since 1977, and specifically since 3rd of November 2007. There is no doubt the same question has come up several (or I would say NUMEROUS) times in front of the Supreme Court of Pakistan. Everytime they failed and they failed miserably , once (Asima Jilani Case) or twice (Junejo/Saifullah Case) they posed as if they have enough courage to put things in order , but both times the dictator(s) who created the mess were dead, however the court so much afraid of the their GHOSTS that even then could not pronounce the fair judgment.
So the question is Can they do it??
Let me assume that the fourteen honourable judges are for the first time bold enough to be fair. Let me also assume that the judges have enough support from the people of Pakistan which will give them courage to stand against all the odds (read army). Let me also suppose that Chief Justice Iftikhar Chaudary and Justice Khalil Rahman Ramday and their brother judges have no bias (except as permitted by the law) against the mad dictator (Musharraf) and his cronies. EVEN then the question is “Can they do it?”.
The current case is only the precursor to a series of several cases that will be coming based on the decision of this case. However judgement in this case will define the nature of coming cases. I would try to discuss the merits of this case in this series (aah… I hope I could complete that… I am following the case , although I don’t have access to the Supreme Court nor do I have the complete reports) but based on the news reports (Particularly from Sohail Khan of The News) , I would try my best to comment on the day to day proceedings of this case.
